Nothing in this section excludes liability of Nuochen or Shenzhen HaolvTo for its own negligent selection, incorrect information transfer, translation error, contractual non-performance, wilful misconduct, gross negligence or any other liability that cannot lawfully be excluded. 10. Hospital and Doctor Matching; Substitution 1. Nuochen proposes candidate options based on records, condition, budget, timing, provider feedback and patient preferences. Acceptance, the treating clinician and the plan are independently decided by the medical institution and doctor. 2. If a specified doctor becomes unavailable because of scheduling, leave, academic duty, emergency work, departure, health or hospital arrangements, Nuochen will use reasonable efforts to coordinate a substitute in the same specialty or with relevant experience, subject to the Patient's prior written approval. 3. Nuochen must not change a specifically confirmed hospital, doctor or principal treatment arrangement without the Patient's written approval. 4. If the Patient rejects an alternative and no new arrangement can be agreed, unperformed services and refundable amounts are handled under the refund section below. 11. Medical Records and Translation 1. The Patient must provide accurate, complete and timely identity information, history, allergies, medication, infectious-disease information, prior operations, imaging, pathology, laboratory results and other information reasonably required by the medical institution. Information must not be concealed, fabricated or altered. 2. Missing, illegible, outdated, incompatible or inconsistent records may lead to rejection, additional tests or revision of a preliminary plan. 3. Nuochen must apply professional translation and review measures proportionate to the risk of the document. Machine translation must not be the sole basis for critical diagnostic, pathology, surgical, medication or informed-consent information. 4. If an identity-record mismatch, medical translation error or omission is discovered, Nuochen must stop further circulation of the incorrect material, notify relevant parties, correct it and assess the impact. If Nuochen is responsible, correction will be provided without additional charge and responsibility will be assumed in accordance with law. 5. A translation facilitates communication and does not replace the official medical record created by a medical institution. The Patient must retain originals and present them when requested. 12. Informed Consent and Medical Decisions 1. The medical institution and healthcare professional are responsible for explaining the condition, proposed measures, risks, alternatives and other legally required information and for obtaining informed consent. 2. Nuochen may coordinate interpretation and explain processes, but does not replace the doctor's professional disclosure or make medical decisions for the Patient. 3. The Patient must decide whether to accept an examination, anaesthesia, surgery, treatment, medicine or other medical measure after adequate understanding and should ask the doctor for further explanation where needed. 4. Consequences caused by refusing reasonable examination, concealing material information, failure to follow medical advice or unilaterally changing treatment will be allocated according to facts, fault and applicable law. Nuochen will continue to provide any assistance required within its contractual scope. 13. Fees, Quotations and Payment 1. Nuochen service fees, inbound travel and local-support fees charged by Shenzhen HaolvTo, and medical fees charged by a medical institution are separate and must identify the relevant service and payee. 2. Medical fees should in principle be paid directly by the Patient to the medical institution. Nuochen and Shenzhen HaolvTo must not disguise unincurred medical fees as platform or travel fees or collect medical fees without authority. 3. Medical cost, treatment length and hospital stay mentioned on the website or during preliminary discussions are estimates based on available records and are not the final hospital bill. The final amount is determined by the medical institution's written quotation and actual services. 4. If further treatment, a revised plan, a longer stay or special drugs or devices become necessary after assessment, the medical institution should explain the reason, risk and cost and obtain consent. Emergency measures are handled under applicable law and hospital procedures. 5. Currency, exchange rate, tax, payment charge, invoice and receipt rules are governed by the order and payment page. Mandatory charges must not be hidden and paid extras must not be pre-selected without valid consent. 6. Deposits, instalments, due dates and payees must be stated in the order. Payment should be made only to an account identified in the contract, order or official written notice. 14. Inbound Travel Services and Foreign-Currency Account Shenzhen HaolvTo is engaged to provide inbound travel and local support for applicable orders and may collect the corresponding inbound travel service fees under the contract or order. Foreign-currency payment is not yet available. Account details will be provided later. 1. This account is used only for inbound travel and local-support fees expressly identified in the contract or order. It is not a medical institution's account for medical charges. 2. Before remittance, the payer must verify the contracting party, account, currency, amount, order number and payment purpose. Any account-change notice must be verified through 983926443@qq.com and a second independent contact method stated in the contract. 3. Nuochen and Shenzhen HaolvTo will not instruct a payer to remit to an unconfirmed personal account. If phishing, an imitation website or an unverified account change is suspected, contact the bank and Nuochen immediately. Responsibility will be determined according to facts, fault and applicable law. 4. Allocation of remittance charges, intermediary-bank charges and exchange-rate differences must be stated in the order. 15. Appointment, Scheduling and Changes 1. Hospitals, doctors, beds, operating rooms, medicines, devices and testing resources are subject to final confirmation and actual availability at the medical institution. 2. “Expected acceptance”, “proposed doctor” and “preliminary plan” do not mean an appointment or resource has been secured unless confirmed in writing by the institution. 3. Changes in condition, testing or provider assessment may change the doctor, plan, cost, duration or itinerary. Nuochen will notify the Patient and coordinate an executable alternative. 4. A material change to service scope, price, time, hospital, doctor or principal itinerary must be recorded in writing and approved by the Patient. A quotation must be revalidated after expiry. 16. Cancellation, Refund and Inability to Secure Acceptance 1. A refund calculation must distinguish completed services, unperformed services and third-party costs actually paid and lawfully non-refundable. 2. If no hospital or doctor is willing or able to accept the Patient after reasonable matching, Nuochen will provide an itemised record of completed work and actual costs. The balance of service money will be refunded after deducting reasonable costs that were actually incurred, disclosed in advance and lawfully non-refundable. 3. If a service cannot be completed because of breach by Nuochen or Shenzhen HaolvTo, the responsible party will refund the fee for the unperformed portion and assume its own responsibility under law. Its internal operating costs must not be deducted from a statutory refund. 4. If service stops because the Patient cancels, fails to provide information on time, refuses reasonable cooperation, does not pay or conceals material information, fees for completed work and lawfully non-refundable third-party costs may be settled under the order. The remaining balance will be refunded within fifteen business days after the amount and receiving details are confirmed, with an itemised statement. 5. If a hospital, doctor or other provider cancels and the Patient rejects a reasonable alternative, Nuochen will assist in recovering refundable third-party amounts and refund Nuochen's fee for the unperformed portion. Evidence must be provided for incurred, lawfully non-refundable third-party costs. 6. Amounts paid directly to a hospital, airline, hotel, insurer or other provider are governed by that provider's lawful cancellation terms disclosed before payment. Nuochen and Shenzhen HaolvTo will assist within their contractual scope and must not fabricate a “non-refundable” charge. 7. A refund does not restrict the Patient's right to complain, report, litigate or seek another legal remedy. 17. Visa, Travel, Insurance and Events Beyond Reasonable Control 1. Visa, immigration, customs, aviation, accommodation, transport, tourism, insurance and destination rules may change. Nuochen and Shenzhen HaolvTo may assist, but decisions are made by the relevant authority or provider. 2. Visa refusal, flight delay or cancellation, natural disaster, epidemic, war, strike, government action or another event beyond reasonable control may affect travel and treatment. The parties must give prompt notice, reasonably mitigate loss and discuss rescheduling, alternatives or refund. 3. The Patient should obtain insurance appropriate to the condition, pre-existing illness, overseas medical care, medical evacuation and planned activities. Coverage and claims are decided by the insurer under the policy. 4. Fitness to fly after discharge must be assessed by a doctor. The Patient must not request an inaccurate fitness determination merely because a return ticket has been purchased. 18. Patient Responsibilities The Patient and authorised representative must: • provide true, accurate, complete and current information; • confirm plans, sign documents and pay on time; • respect healthcare and service personnel and comply with hospital, immigration, public-safety, accommodation and transport rules; • promptly disclose changes in condition, infectious risk, allergy and emergency; • not request an unlawful, false, undeliverable or professionally improper promise; • protect passports, visas, records, medicines, valuables and personal belongings; and • personally confirm material medical decisions, or ensure that a representative has valid authority. 19. Personal Information and Medical Privacy 1. Identity, passport, contact, medical and health, genetic, biometric, financial-account, travel-location and minor information may be sensitive personal information. 2. Nuochen processes such information only for a specific and necessary purpose with strict protective measures. Before processing, it must disclose the purpose, method, categories, retention period, recipients, necessity and impact and obtain separate consent where required. 3. To perform the requested service, Nuochen may provide necessary information to a hospital, doctor, interpreter, patient-accompaniment provider, Shenzhen HaolvTo, insurer or other provider chosen or considered for matching. Recipients and scope must be disclosed in the Privacy Policy or a separate notice. 4. If information is to be provided from China to a medical institution, representative or other recipient outside China, separate cross-border compliance steps and consent will be completed. Acceptance of these Terms does not replace legally required separate consent. 5. The Patient may exercise rights of access, copy, correction, supplementation, deletion, withdrawal of withdrawable consent and explanation in accordance with law. Withdrawal does not invalidate lawful processing before withdrawal, but may prevent continuation of a service that requires the information. 6. Information of a child under 14 requires consent of a parent or other guardian and must be processed under special rules. 7. Public use of a case, likeness or treatment experience requires separate, voluntary, specific and revocable written authorisation. Refusal or withdrawal of marketing authorisation does not affect normal service. 8. Further rules appear in the Privacy Policy, Separate Consent for Processing Sensitive Personal Information and Separate Consent for Cross-Border Provision of Personal Information. These Terms do not replace those documents. 20. Medical-Record Delivery, Follow-up and Completion Unless the order provides otherwise, completion will normally require at least: 1. completion of the contracted assistance, interpretation, accompaniment, transport and accommodation services; 2. settlement of service fees, refunds and payment matters that the relevant service provider agreed to coordinate; 3. assistance in obtaining and delivering available medical records, test results and related materials; 4. closure of, or a clear plan for, unresolved matters within the relevant provider's responsibility; 5. a clear post-return follow-up or referral arrangement; 6. agreed assistance with referral and medical-record handover where care will continue in the home country; and 7. written confirmation of non-medical service completion, or a specific objection submitted within seven calendar days after notice of acceptance. Acceptance of non-medical services does not waive rights concerning a latent issue, personal-information infringement, medical injury or another statutory claim, and is not acceptance of a medical outcome. 21. After-Sales Responsibility and New Requests 1. If Nuochen or Shenzhen HaolvTo causes a medical-translation error, record omission, uncompleted contracted service or failure to perform an agreed follow-up action, the responsible party will correct it without further charge within a reasonable time and take necessary remedial measures. 2. A new condition, change of hospital, additional treatment plan, later trip to China or additional out-of-contract service is a new medical or service request requiring reassessment, quotation and agreement. 3. Patient safety and the immediate practical problem will be addressed before internal responsibility is investigated. Internal accountability must not delay necessary assistance. 22. Liability and Liabilities That Cannot Be Excluded 1. Each party is responsible according to its contractual duty, conduct, fault and applicable law. 2. To the extent permitted by law, Nuochen and Shenzhen HaolvTo do not guarantee against medical outcomes, independent professional decisions, government decisions, carrier cancellation or force-majeure effects outside reasonable control and not caused by their breach or fault. They must still give notice, assist and reasonably mitigate loss. 3. These Terms do not exclude or limit liability for wilful misconduct or gross negligence, liability for personal injury that may not lawfully be excluded, liability for breach of personal-information obligations, statutory consumer refund or compensation rights, or any other liability that applicable law prohibits from being excluded or limited. 4. A unilateral statement that Nuochen has “final interpretation rights” does not apply. Ambiguity will be interpreted under applicable law and principles of fairness and good faith. 23. Website Content, Cases and Intellectual Property 1. Hospital, doctor, technology, case, image and data content must have a lawful source and remain truthful, accurate and current. Historical information must state the relevant date and that it is for reference only. 2. Testimonials, expert imagery, individual outcomes or unverifiable data must not be used to prove a general medical effect. Claims of guaranteed cure, absolute safety, highest success rate, uniqueness, first status or greatest authority must not be made without a lawful and verifiable basis. 3. A third-party link is provided for convenience and is not an endorsement of all content, service or security on that site. 4. Nuochen content protected by law may not be copied, altered, sold or used misleadingly without permission. A Patient's legal rights in personal information and medical records do not transfer to Nuochen under this section. 24. Complaints and Disputes 1. Contact and complaint email: 983926443@qq.com. Current service hours, telephone and online channels are those displayed on Nuochen's official website. 2. A complaint should, where possible, include the order number, date, facts, records and requested resolution. Nuochen or Shenzhen HaolvTo will acknowledge, investigate and provide progress information in a timely manner. 3. A dispute concerning medical conduct, medical injury or hospital charges may be submitted to the medical institution, the competent health authority where the institution is located, a medical-dispute mediation body or another competent authority. Nuochen will assist with service records within its possession. 4. The parties should first seek an amicable resolution. If no resolution is reached, the laws of the People's Republic of China apply and a party may bring proceedings before a court with jurisdiction or use another dispute-resolution method permitted by law. Nothing in this section unreasonably restricts a consumer's right to complain, report, litigate or choose another provider. 25. Languages, Updates and Severability 1. These Terms are supported in Simplified Chinese, Traditional Chinese, Russian, Arabic and English. Translations assist understanding and must not conceal or alter material rights and obligations. 2. If language versions materially differ, interpretation will take account of the valid language version expressly selected in the specific service agreement. Fees, refunds, risks, data processing and liability must be explained in a language the Patient can understand. 3. Nuochen may update these Terms because of legal, regulatory, business or service changes and will display the version and effective date prominently. An update does not automatically change a confirmed order retroactively unless law requires or the parties agree. 4. If any provision is invalid or unenforceable, the remaining provisions continue to the extent permitted by law. Payment and Fraud-Prevention Notice Before payment, verify the contract, order, payee and bank account. Any account change must be verified through 983926443@qq.com and a second independent channel stated in the contract. Medical fees should normally be paid directly to the medical institution. Nuochen and Shenzhen HaolvTo will not request payment to an unconfirmed personal account. This version was updated on 21 October 2026. Users should download and retain the version in effect when an inquiry or payment is submitted.
